The investigation and handling of insurance claims revolves around documentation availability. The Data Protection Acts, including the recent 2018 update required by the EU’s General Data Processing Regulations (GDPR), now means that even greater care must be taken to balance what we disclose with individuals' privacy. The dangers of getting this wrong have been highlighted by Lloyd v Google [2019] in that damages are payable for the misuse of data even when the Claimant has not suffered a financial loss.
