Welcome to this edition of our Natural Resources’ Elements Newsletter, where we explore some of the technical, operational and regulatory issues shaping today's global insurance and risk landscape.

As the energy and natural resources sectors continue to evolve, so too do the challenges faced by insurers, brokers, reinsurers and insureds. From technological innovation and complex industrial processes to changing regulatory frameworks and international market dynamics, understanding the nuances of risk has never been more important.

In this edition, we examine four topics that highlight the breadth and depth of expertise required to navigate modern claims environments. We begin with a fascinating exploration of causation and coverage in heavy industry through Paul Martelli’s article ‘Breaking the Chain’, which considers the legal concept of Novus Actus Interveniens in the context of a complex iron smelting loss.

We then turn to the rapidly expanding offshore wind sector, where Ed Hillier’s Article ‘OEM Warranties’ examines the increasingly complex relationship between OEM warranties, insurance programmes and business interruption exposures.

Our focus then shifts to Latin America with Mariana Martinez’ and James Marks’ article ‘Working to the unique claims rhythm of Latin America’, which explores the distinctive regulatory, cultural and operational characteristics that influence the management of large and complex claims across the region.

Finally, we consider the implications of Brazil's significant insurance market reforms through Manuel Taratino’s article ‘Dancing to the new beat in the Brazilian insurance market’, examining how new legislation is reshaping claims handling, policyholder protections and the relationship between insurers and reinsurers.

While diverse in subject matter, each article reflects a common theme: the importance of combining technical expertise, local market knowledge and practical claims experience to deliver effective solutions in an increasingly complex environment. We hope these perspectives provide valuable insight and stimulate further discussion across the market.

Working to the unique claims rhythm of Latin America

The Latin American region has some specific characteristics that require careful consideration to ensure the smooth interplay between local insures, their international reinsurers and all the associated stakeholders following a large loss.
